What is PC 243(c)(1) / Battery on a Custodial Officer / Medical Personnel with Injury?
To prove that a defendant is guilty of PC 243(c)(1) the prosecutor must prove five things:
(1) The defendant willfully and unlawfully touched the custodial officer or medical personnel in a harmful or offensive manner;
(2) When the defendant acted, the person battered was a custodial officer, medical personnel or other protected person and was performing his or her legal duties;
(3) When the defendant acted, he/she knew, or reasonably should have known, that the custodial officer or medical personnel was performing his or her duties;
(4) The custodial officer or medical personnel suffered injury as a result of the touching;
AND
(5) The defendant did not act in self-defense or defense of someone else.
