To prove that a defendant is guilty of PC 273d(a) the prosecutor must prove three things:
1. The defendant willfully inflicted cruel or inhumane physical punishment or injury on a child;
2. The punishment or injury inflicted by the defendant caused a traumatic physical condition to the child, and;
3. The defendant did not act while reasonably disciplining a child
A child is any person under 18 years of age.
A traumatic physical condition is a wound or other bodily injury, whether minor or serious, caused by the direct application of physical force.
