What Are The Different Domestic Violence Charges In California?

In California, there are a certain charges that are specific to just domestic violence cases.

However, prosecutors can also designate a case to be “domestic violence” if they file other more general charges but the relationship between the parties qualifies under Section 6211 of the Family Code.

The most common charges Domestic Violence specific charges are:

Infliction of Corporal Injury on a Spouse or Cohabitant

Other Domestic Violence Charges

Penal Code 273.5(a) – Corporal Injury to a Spouse/Cohabitant
Penal Code 273.5(f) – Corporal Injury to Spouse/Cohabitant w/ Prior
Penal Code 243(e)(1) – Simple Battery on a Spouse/Cohabitant
Penal Code 273.6 – Violation of a Restraining Order
Penal Code 262 – Spousal Rape
Penal Code 273a(a) – Abusing or Endangering the Health of a Child
Penal Code 273a(b) – Child abuse Causing Injury

Other charges not exclusive to Domestic relationships, but that are commonly filed with Domestic Violence designations are:

Any case that has been designated “Domestic Violence” for which probation is granted has strict mandatory terms, including a 52 week Domestic Batterer’s Class, Community Service, Fines, and issuance of a Protective Order (otherwise known as a Restraining Order.)
