Is Battery Causing Serious Bodily Injury (243(d)) a “Strike” In Riverside County or Orange County?

Posted in Assault FAQ'S on March 11, 2015

It depends. Penal Code 243(d) / Battery Causing Serious Bodily Injury is NOT by itself a “Strike” under California’s Three Strikes Law.

However, if the injury inflicted is serious enough and determined to be “great bodily injury” then it would be considered a “Strike” under California’s Three Strikes Law.

Whether or not an injury is “great bodily injury” depends heavily on the facts of your particular case. “Serious Bodily Injury” and “Great Bodily Injury” are different.

Generally speaking,“Serious Bodily Injury” is a lesser standard than “Great Bodily Injury”.

If you or your family is going through a battery causing serious bodily injury case, give me a call: Riverside – (951) 667-5293 and Orange County – (714) 758-5293.
